This Privacy Policy ("Policy") describes how ComplianceOne Consulting Limited (the “Company”) collects and uses the personally identifiable information ("Personal Information") you may provide on the www.complianceone.hk. By using this site, you are agreeing to the terms set out in this Policy.

ComplianceOne Consulting Limited is committed to protecting your personal data, defined as information relating to a living individual from whom it is practicable to ascertain identity, in accordance with the requirements of the Personal Data (Privacy) Ordinance (the “Ordinance”). The Company will take all reasonable steps to ensure that your personal data is secure against unauthorized access, loss, disclosure, and destruction. Please note that this Statement supersedes any previous notice or statement of a similar nature issued by the Company under the Ordinance.

Obligation to Disclose Personal Data

Unless otherwise specified, you are required to provide personal data requested by us in connection with the opening or continuation of accounts, the provision of services or products, or the use of certain features of our website, including employment application submissions. Failure to provide such data may result in the Company being unable to open or maintain accounts or provide services or products to you or related companies, or to process an employment application due to insufficient information.

Purposes and Retention of Information

  1. It may be necessary for clients and other individuals (“data subjects”) to supply the Company with data related to various matters, including account opening, service provision, or compliance with laws or guidelines issued by regulatory authorities.

  2. Such data may include, but is not limited to, information collected during the continuation of the Company’s relationship with data subjects, such as when clients open accounts, write cheques, attend seminars/events, or communicate verbally or in writing with the Company.

  3. The purposes for which data relating to a data subject may be used include the following:

    • Processing applications for accounts with the Company.

    • Daily operation of services.

    • Marketing compliance services or related products.

    • Meeting disclosure and compliance requirements under applicable laws and regulations.

    • Evaluating employment applications and managing human resources functions for successful candidates.

 

Disclosure of Personal Data

All personal data, whether provided by you or another person, may be disclosed, exchanged, or transferred under the following circumstances, whether recipients are within or outside Hong Kong:

  • Third-party disclosures may include sharing information with non-affiliated companies that provide support services, including professional, legal, or accounting advice.

  • Personal information may also be disclosed to fulfill your instructions or with your express consent.

  • For employment applicants or current employees, personal data may be shared with entities providing human resources-related services, including background checks.

  • Under limited circumstances, personal information may be disclosed to third parties as permitted by, or to comply with, applicable laws and regulations.

 

Use of Data in Direct Marketing

  1. The Company intends to use data subject’s personal data for direct marketing and requires consent from the data subject (including an indication of no objection) for that purpose. The specific consent requirements under Part VIA of the Ordinance will take effect from 1st April 2013.

  2. Direct marketing activities may include, but are not limited to:

    • Offering or advertising the availability of goods, facilities, or services.

    • Sending information or goods addressed to specific individuals by name via mail, fax, electronic mail, or other communication means.

    • Making telephone calls to specific individuals.

  3. The Company may use the name, contact details, product and service information, financial background, and demographic data of the data subject for direct marketing.

  4. In addition to marketing services and products provided by the Company, the Company may also share data with third parties (as permitted by applicable laws) for their marketing purposes, requiring the data subject’s written consent (including an indication of no objection) for that purpose.

  5. If a data subject does not wish for the Company to use or provide their data for direct marketing, they may exercise their opt-out right by notifying the Company.

 

Rights of the Data Subject

Under the Ordinance, individuals have the right to:

  1. Verify whether our company holds their information and to access such information;

  2. Request the correction of any inaccurate information related to them;

  3. Object to the use of their personal data for marketing purposes. Upon receiving a notification of refusal, our company shall not use their personal data for marketing purposes.
