ADMISSION SCHEME FOR MAINLAND TALENTS
AND PROFESSIONALS (ASMTP)

Eligibility Criteria for Individual Applicants:

) There is no known record of serious crime

2) The applicant has a bachelor’s degree or higher education background

3) The applicant has a confirmed offer of employment and:

A. the job vacancy is a professional or managerial position

B. the job relevant to his academic qualifications or work experience that cannot be readily taken up by the local work force

C. the remuneration package including income, accommodation, medical and other fringe benefits is broadly commensurate with the prevailing market level for professionals in Hong Kong

4) Application form: ID 990A

Top-tier Professionals:

1) The applicant has an assessable income for salaries tax of not less than HK$2 million in the previous year of tax assessment

2) Initial stay is 24 months on employment condition

3) Extension of stay normally will be granted on 6 years pattern

4) For change of employment, Top-tier Professionals should notify the Immigration Department in writing within the currency of their permitted limit of stay

Introduction:

1) Commonly referred to as “Working Visa”

2) To attract qualified Mainland talents and professionals to work in the HKSAR

3) Quota-free and non-sector specific

4) Applicants may apply to bring in their dependants (spouse and children under the age of 18)

Professionals:

1) Initial stay is 24 months on employment condition

2) Extension of stay normally will be granted on 3+3 years pattern

3) For change of employment, Professionals - should seek prior approval from the Director of Immigration for any change in employment

Eligibility Criteria for Company (the Employer) Applicants:

1) The employing company should provide their company background and business nature

2) A detailed business plan (e.g. information on source of funds, estimated capital injection, nature/mode of business activities, expected turnover, sales volume, gross and net profit in the coming years, and proposed creation of local job posts, etc.)

3) Photocopy of proof of financial standing

4) Maintain a proper proportion of local and non-local employees

QUALITY MIGRANT ADMISSION SCHEME (QMAS)

Points-based Tests:

Scheme Objective:

According to Immigration Department, the Scheme is a quota-based entrant scheme. It seeks to attract highly skilled or talented persons to settle in Hong Kong in order to enhance Hong Kong's economic competitiveness. Successful applicants are not required to have secured an offer of local employment before their entry to Hong Kong for settlement. All applicants are required to fulfill a set of prerequisites before they can be awarded points under one of the two points-based tests, namely the General Points Test and Achievement-based Points Test and compete for quota allocation with other applicants. Successful applicants under the Scheme may bring their spouse…and unmarried dependent children under the age of 18 to Hong Kong provided that they are capable of supporting and accommodating their dependants on their own financial resources without relying on public assistance in Hong Kong.

Selection Exercise:

1) Selection exercises will be done on a regular basis for quota allocation to applicants.

2) During each selection exercise, applicants who satisfy both the prerequisites and the minimum passing mark (under the General Points Test) or the one point-scoring factor (under the Achievement-based Points Test) will be ranked according to scores awarded. High scoring applications will be short-listed for further assessment.

3) The Director of Immigration may seek advice from the Advisory Committee on Admission of Quality Migrants and Professionals (the Advisory Committee) on the assessment, point-scoring and allocation of quota under the Scheme. The Advisory Committee comprises official and non-official members appointed by the Chief Executive of the HKSAR. The Advisory Committee will consider the socio-economic needs of Hong Kong, the sectoral mix of candidates and other relevant factors, and recommend to the Director of Immigration how best to allocate available quota in each selection exercise.

4) Meeting the minimum passing mark or high-scoring applications do not necessarily secure quota allotment.

Prerequisites:

Age:18 or above

Good character:The applicant should not have any criminal record or adverse immigration record in Hong Kong or elsewhere.

Language proficiency:The applicant should be proficient in written and spoken Chinese (Putonghua or Cantonese) or English.

Basic educational qualification:normally a first degree from a recognized university or a tertiary educational institution.

Financial requirement:The applicant must be able to demonstrate that he/she is capable of supporting and accommodating himself/herself and his/her dependants, if any, on his/her own financial resources without relying on public assistance during his/her stay in Hong Kong.
(Acceptable assets include bank deposits, real estate, securities and interests in privately-owned businesses.)

IMMIGRATION ARRANGEMENTS
FOR NON-LOCAL GRADUATES (IANG)

Eligibility Criteria for IANG

Applicants who are/were non-local students and have obtained an undergraduate or higher qualification in a full-time and locally accredited programme in Hong Kong (hereafter “non-local graduates”) may apply to stay/ return and work in the HKSAR under the IANG.

Types of IANG:

1) Non-local fresh graduates

A. who submit applications to the Immigration Department within six months after the date of their graduation

B. are not required to have secured an offer of employment upon application

2) Returning non-local graduates

A. who submit applications beyond six months of the date of their graduation;

B. are required to secure an offer of employment upon application

C. the job is at a level commonly taken up by degree holders and the remuneration package is at market level

D. regardless when the applicants obtain the graduation certificates

GENERAL EMPLOYMENT POLICY(GEP)
(FOR NON-MAINLAND RESIDENTS)

Introduction:

1) Commonly referred to as “Non-Mainland residents working visa”

2) Applicants who possess special skills, knowledge or experience of value to and not readily available in the HKSAR (e.g. professionals and entrepreneurs) may apply to come to work under the GEP

3) The GEP is quota-free and non-sector specific

This entry arrangement is not applicable to:

1) Chinese residents of the Mainland

2) nationals of Afghanistan, Cuba, Laos, Korea (Democratic People's Republic of), Nepal and Vietnam

This entry arrangement is applicable to:

1) Overseas Chinese nationals holding People's Republic of China passports

2) The applicant has been residing overseas for at least one year immediately before the submission of application and that the application is submitted from overseas

Eligibility Criteria for GEP:

1) there is no security objection and no known record of serious crime in respect of the applicant

2) the applicant has a good education background

3) there is a genuine job vacancy
